In 2011, the Internet Governing Body ICANN (Internet Corporation for Assigned Names and Numbers) announced a program to the liberalization of the top-level domain (TLD) market. The goal of the New generic Top-Level Domain Program (suffixes) is to increase the competition, innovation and consumer choice in the addressing system of the Internet. In the first half of 2012 ICANN accepted applications from large Organizations wanting to use new domain extensions. ICANN has received more than 1900 applications for new top level domains. The first New Gtld will be released on the 23rd of April in 2013. The first New domains could go live for the general public in autumn 2013. We're Not Trying To 'Alarm' You - But Make Sure You Know The Hard Facts About Digital Domain Ownership Rights

Way too many times people and companies have expressed that their outsourced 'Web-Master' is NOT repsonding to their inquiries and requests or may have disappeared entirely.  Unfortunately, we find this to be a very common scenario that happen way too often.  That where RPM comes in as a lot of times companies and individuals approach us to help them get their website, email and digital marketing up-to-date and back on track.  But many times our hands are tied due to the governing laws to digital property.  So please be aware that there may be a BIG ROAD BLOCK you may face to accomplish your goals.

  • STEP FIVE - NO REPSONSE FROM YOUR WEBSITE PROVIDER - If you're not getting results from your website provider or can't even get them to call you back (and it happens a more than you think), contact the offical REGISTRAR directly.  Explain your problem to the WHOIS registrant record and ask them to help.

  • They will put you in touch with their Legal and Compliance Department.  Most times they are very cooperative and will do everything in their power to help you.  However, please be aware that they will require you to supply a 'mountain of paperwork' for them to help you.  You have to prove beyond a doubt that you should be listed as the 'TRUE' owner of the web domain in question.  But be forewarned, most of the time, their hands are tied as your 'Website Provider' is acutally 'Legally' the owner of the domain on the existing documents in the eyes of most legal teams.  Your only course of action if it reaches this point, is to contact an attorney in your area that specializes in Intellectual Property Law.  Only a judge or abitrator can resolve your issue of ownership.

  • STEP THREE - IF YOU'RE HERE... TREAD CAREFULLY GOING FORWARD!  HERE'S WHY...

Our experience has shown that there are TWO TYPES of digital service providers... Your website provider is most likely just like the vast majority of companies are stand-up, honest and very straight shooters.
But then there website providers who's companies and professional ethics are questionable at best... and these are one's that will cause you nightmares and maybe even disrupt your digital business both short and long term.  Remember that your website, email and other online resources may be tied to your domain.

  • STEP FOUR - WHAT TO DO NOW - Contact the company that registered your domain.  Explain to them that you found out that the WHOIS records is incorrect and you would like it updated.  ONLY THEY CAN UPDATE THE RECORD THAT YOU OWN YOUR DOMAIN WITH ICANN!  SO PLAY NICE!  (Remember that the Registrar Companies (I.E.: GoDaddy, Network Solutions, etc.) hands are bound 99% of the time by State, Federal and International laws and they are not the ones that got you into this mess, it was your web solution provider).

  • DID YOU GET OWNERSHIP OF YOUR DOMAIN?  If so, congratulations.  Contact RPM if we can help enhance your digital presence going forward.  IF NOT... SEE STEP FIVE.   NOW IT GETS UGLY!!
